Aegis365™ Terms of Use

1. Ownership; Agreement to Terms

These Terms of Use (“Terms”) govern your access to and use of Aegis365.com, including any associated websites, web-based applications, mobile or tablet applications, dashboards, software, and related services (collectively, the “Services”).

The Services are owned and operated by The Safe Community Project, a California nonprofit public benefit corporation and 501(c)(3) public charity (“Safe Community Project,” “we,” “us,” or “our”).

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

If you do not agree, do not access or use the Services.

2. Changes to These Terms

We may update or modify these Terms at any time in our sole discretion. Changes are effective when posted. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

3. Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you represent that you have permission from a parent or legal guardian.

4. License to Use the Services

Subject to your compliance with these Terms, Safe Community Project grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for lawful, personal, educational, community, or authorized organizational purposes.

You may not:
  • Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Services
  • Reverse engineer, decompile, or attempt to extract source code
  • Circumvent security features or access controls
  • Use the Services for unlawful, misleading, or harmful purposes

5. Nature of the Services; No Professional or Safety Guarantees

Aegis365 provides informational, educational, and planning tools related to home hardening, wildfire risk awareness, and community resilience.

The Services:
  • Do not provide engineering, construction, fire protection, insurance, legal, or emergency response advice
  • Do not guarantee compliance with any building code, wildfire regulation, insurance requirement, or standard
  • Do not ensure protection from wildfire, property damage, injury, or loss of life

You are solely responsible for verifying information with qualified professionals and applicable authorities.

6. User Accounts and Information

If registration is required, you agree to provide accurate, current, and complete information and to keep it updated. We may suspend or terminate access if information is inaccurate or misleading.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

7. Acceptable Use and Security

You agree not to:
  • Probe, scan, or test system vulnerabilities
  • Attempt unauthorized access to systems or data
  • Use automated tools (bots, scrapers, spiders) without permission
  • Interfere with system performance or integrity

8. Content Ownership and Intellectual Property

All content and materials within the Services — including software, text, graphics, interfaces, logos, trademarks, videos, and design elements (“Content”) — are owned or licensed by Safe Community Project and protected by intellectual property laws.

You may not reproduce or distribute Content except as expressly permitted by these Terms.

9. User Submissions

Any feedback, suggestions, or non-confidential materials you submit voluntarily may be used by Safe Community Project without restriction or compensation.

Do not submit sensitive personal data, confidential incident reports, or proprietary materials unless expressly requested and governed by a separate written agreement.

10. Third-Party Services and Data

The Services may include or rely upon third-party tools, mapping services, data sources, or integrations. Safe Community Project does not control and is not responsible for the accuracy, availability, or reliability of third-party services.

11. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, Safe Community Project disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law:
  • Safe Community Project shall not be liable for indirect, incidental, consequential, special, or punitive damages
  • Our total liability for any claim shall not exceed the amount, if any, paid by you for the Services in the twelve (12) months preceding the claim

Your use of the Services is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Safe Community Project and its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

14. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any violation of these Terms or misuse of the Services. Upon termination, all rights granted to you immediately cease.

15. Copyright and Infringement (DMCA)

Safe Community Project respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. §512). Claims of infringement must be submitted in writing to our designated agent with all required statutory information.

16. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any legal action must be brought exclusively in state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

17. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between you and Safe Community Project regarding the Services.
